After the U.S. Supreme Court ruled in a 5-4 decision in 2012 that lengthy sentences for juveniles without the possibility parole are unconstitutional, the trial court ordered a new sentencing hearing for Gordon. The state appealed that ruling, arguing before the high court that Gordon's counsel used too narrow a law under which to seek a new sentencing, one that provides relief if a sentence is illegal or the court lacked jurisdiction to rule. "This is an easy case," Assistant Attorney General Christian Harris said, arguing that Gordon was legally sentenced. Attorney Jeff Rosenzweig argued for Gordon that the Arkansas high court has already set precedent in finding other juveniles deserved new sentences. "There is nothing this person could have said to get anything less than life without parole," Rosenzweig said. The high court will issue its ruling later. When Gordon was tried, prosecutors had a document indicating Gordon was 18 years old or qualified as an adult. In filings that led to the trial court ordering the new sentencing, lawyers for Gordon submitted his birth certificate, showing he was 17 at the time of Webster's murder, which would make him a juvenile. Justice Karen R. Baker asked whether it was formally established in court that Gordon was a juvenile. Rosenzweig said there wasn't a hearing specifically on the age question but said prosecutors didn't object or raise any issues to challenge that Gordon was 17. Harris also argued that there is a question whether the U.S. Supreme Court's ruling can be applied retroactively in Arkansas. Rosenzweig said fixing past errors is the point of the ruling. The U.S. Supreme Court ruled in Miller v. Alabama that, for juveniles, long sentences without parole are cruel and unusual and thus are unconstitutional.
