When Gordon was tried, prosecutors had a document indicating Gordon was 18 years old or qualified as an adult. In filings that led to the trial court ordering the new sentencing, lawyers for Gordon submitted his birth certificate, showing he was 17 at the time of Webster's murder, which would make him a juvenile. Justice Karen R. Baker asked whether it was formally established in court that Gordon was a juvenile. Rosenzweig said there wasn't a hearing specifically on the age question but said prosecutors didn't object or raise any issues to challenge that Gordon was 17. Harris also argued that there is a question whether the U.S. Supreme Court's ruling can be applied retroactively in Arkansas. Rosenzweig said fixing past errors is the point of the ruling. The U.S. Supreme Court ruled in Miller v. Alabama that, for juveniles, long sentences without parole are cruel and unusual and thus are unconstitutional.
