Now that the dust has settled on Superintendent of Public Instruction Cindy Hill and her duties in leading the Wyoming Department of Education, it is a good time to discuss changes to that position.But as we saw a few days ago, lawmakers appear to still be reeling from the ruling by the Wyoming Supreme Court that nullified their attempt to significantly alter that position through statute (Senate File 104). Members of the Joint Education Interim Committee, meeting in the Capital City on April 28, declined to call a special session to address the issues.The bottom line is that lawmakers could not reach consensus about altering the superintendent s role through statute. And rightfully so. The High Court has ruled that Ms. Hill (and her successors) must have general supervision of the state s education system, and that includes running the Wyoming Department of Education.It would be fair to note here that no one knew that for certain until the High Court ruled. Lawmakers and Gov. Matt Mead (as well as this newspaper) relied on another part of the state Constitution that permits them to outline the superintendent s duties. But stripping her of the authority to run the agency was beyond the bounds of that clause as everyone now knows.But the Legislature does have options, and it was disappointing to see the committee run away and hide from the best of them: They should seek to change the position from an elected job to an appointed one through constitutional amendment. They can start that now, but apparently they have decided that doing nothing is a better option.But let s recall how we got here. Remember the accountability system from the Legislature that Ms. Hill ignored? Remember Ms. Hill spending funds that lawmakers told her not to spend? Remember all the employees who quit the state agency after Ms. Hill was elected?Well, much of that is happening again now that she has returned to the department. And there is nothing to prevent those who follow her from doing the same.For the good of this state s young people, lawmakers must act to change the position to one that is appointed, either by the governor or perhaps the State Board of Education. That would take elective politics out of the equation and give lawmakers more control over education, which also is, by the way, something that the state Supreme Court has supported in several key rulings.While the ruling on SF 104 was a setback, it shouldn t deter lawmakers from making sure Wyoming offers the best education in the nation. If they can t even bring a system of accountability designed to improve the state s schools into being, how are they ever going to create excellence?The solution is a constitutional amendment to make the superintendent s job appointed. This can be done by approval of two-thirds of the lawmakers in both the House and Senate and then a vote of the people.Until lawmakers do this, they will find themselves stymied again and again by politicians like Ms. Hill.
